Firms exporting products from the United States are often asked by foreign customers or foreign governments to supply a certification relating to products regulated by the Federal Food, Drug, and Cosmetic Act (FD&C Act).
A digital Certificate to Free Sale is an certificate issued by the Food and Drug Administration (FDA). This document assures that the materials listed are on file with the Food and Drug Administration, Department of Health and Human Services.
A food may be exported if it meets the specification of section 801(e) of the FD&C Act [21 U.S.C. 381(e)]. In accordance with the provisions of this section, a food intended for export shall not be deemed to be adulterated or misbranded under the FD&C Act if it:
(a) accords to the specifications of the foreign purchaser
(b) is not in conflict with the laws of the country to which it is intended for export,
(c) is labeled on the outside of the shipping package that it is intended for export, and
(d) is not sold or offered for sale in domestic commerce.
Document issued by the Department of Health and Human Services FDA division can be apostilled through our Washington, D.C. apostille office. Documents received at our offices are submitted directly to the U.S. Department of State – Office of Authentications the following business morning. The current processing time is four business days. We also provide FedEx/UPS overnight return shipping at no additional cost.
