Do you need an apostille on your Petition for Name Change?

A Petition for Name Change issued from the local District Court (Federal Court) must be an original certified copy signed and stamped by the Deputy Clerk and the Clerk of the District Court.  This document should also include two embossments (one for each signature).  We have provided an example below for review.

If you do not have an original signed copy, please contact the local District Court and speak with the Deputy Clerk for instructions.

Authorization of Agent Apostille

Do you need an apostille on a Authorization of Agent agreement?

At International Apostille, we take the guesswork out of obtaining an apostille on your documents.  We can apostille authorization of agent documents signed and notarized in all 50 States and the District of Columbia (Washington DC).

An authorization of agent is when you authorize an individual in another country to act on your behalf and to legally bind you in particular business or personal transactions with third parties pursuant to an agency relationship.  For example, if you are authorizing your brother in Mexico to sell your property and wire the funds to your bank account in the USA.

We recommend that all authorization of agent agreements be created by an attorney in the country requesting your documents.  An attorney will know the laws and can prepare an authorization of agent that is written in both English and in the other language (Example: Spanish).

Before an authorization of agent can receive the State apostille, it must be signed and notarized.  The signer of the document must physically appear before a notary public.  Once notarized, the document can then be mailed in to our office for processing with our apostille order forms.

Question: Can I create my own authorization of agent without an attorney?
Answer: Yes, you can but we highly recommend that your authorization of agent agreement be created by an attorney who knows the laws in the country requesting your documents.

Question: What if my authorization of agent is written in a foreign language? (Example: German)
Answer: We recommend that all authorization of agent documents be written in English and the other language.  Some States will not accept a document if they cannot read the content.  These States include: Alabama, Arkansas, Delaware, Georgia, Hawaii, North Carolina, North Dakota, Oklahoma, South Carolina.  The US Department of State will also not accept a document written in a foreign language.

Question: Can a notary refuse to notarize a document written in a foreign language?
Answer: No, a notary’s responsibility is to either witness you sign the document (Sworn Affidavit) or you would acknowledge that you signed the document.  Proper identification will need to be provided to the notary to valid your name and signature.

Single Status Affidavit Apostille

Do you need to apostille a single status affidavit?

At International Apostille, we take the guesswork out of obtaining an apostille on your single status affidavit.  We can apostille single status affidavits issued from all 50 States and the District of Columbia (Washington DC).

If you are planning to get married in another country who is a member of the Hague Apostille Convention, you will be asked to apostille a document called a single status affidavit.  In some countries, you may also be required to provide this documentation for employment.

Some countries may also refer to this document as:

No Record of Marriage
Certificate of Freedom to Marry
Certificate of No Impediment for Marriage
Certificate of No Record – Marriage
Affidavit of Single Status
Affidavit of Marriageability
Certificate of No Public Record

Here is an example of a single status affidavit:

A single status affidavit can be issued by the local County Clerk, State, and at any U.S. Embassy or U.S. Consulate located outside of the USA.  You can also use the example above to write your own single status affidavit and have it notarized.  If you are in the USA, you can take the document to a local notary who will include the notarial wording at the end of the document or as an attachment to the signed page.  If you are outside of the USA, you can meet with a U.S. Federal notary at the U.S. Embassy or U.S. Consulate office.

Here are a few frequently asked questions…

Question: How old can my single status affidavit be?

Answer: We recommend that your single status affidavit be recently issued.  Most countries want to make sure you are not married in another country so the date of this document should be within 90 days.  We recommend that you check with the country requesting your document on how old this document can be.

Question: Why do I need to apostille a single status affidavit?

Answer: If you are planning to get married in another country, they want to make sure you are currently not married to another in the country you are from.

Question: Can I apostille my California single status affidavit in New York?

Answer: No.  A single status affidavit can only receive the apostille from the State of issue.  For example, a single status affidavit issued from Los Angeles County can only receive an apostille from the State of California. Another example is if your single status affidavit was signed and notarized at a U.S. Embassy or U.S. Consulate outside of the USA, this document can only receive an apostille through the U.S. Department of State in Washington D.C.

Question: What if the State does not accept my single status affidavit?

Answer: In situations where the certificate is not accepted, we will contact you with instructions from the State.

Question: I am currently outside of the USA, where can I get my single status affidavit?

Answer: Please contact the local U.S. Embassy or U.S. Consulate office near you.  You will need to have a single status affidavit completed and notarized by the U.S. Federal notary who is located there.  Once notarized, mail in this document with our Washington DC apostille order forms to our Washington DC office.

Certificate of Naturalization Apostille

The Certificate of U.S. Naturalization is a document issued by United States government as proof of a person having obtained U.S. citizenship through naturalization (a legal process of obtaining a new nationality).  If you do not have a copy of your Certificate of Naturalization, please contact the U.S. Citizenship and Immigration Services.  https://www.uscis.gov/

We can process Certificate of Naturalization documents issued by the U.S. Federal government through our Washington D.C. apostille office.  Documents received by 10:30 am are submitted the following business morning to the U.S. Department of State.  The current processing time with the U.S. Department of State – Office of Authentications is four business days.  Once complete, we will ship your documents by UPS/FedEx overnight return shipping within the USA at no additional cost.

Apostille for Power of Attorney – POA

Do you need to apostille your Power of Attorney (POA)?

A power of attorney signed and notarized in the USA must also receive the apostille from the same-state the document was notarized in. For example, if your documents were notarized in New York, the document must also be apostilled from the State of New York.

Countries who are members of the Hague Apostille Convention will receive an apostille while countries who are not members will receive State certification. For countries who are not members, your documents will require US Department of State certification and Embassy or Consulate legalization.

We recommend that a power of attorney be drafted by a professional attorney from the country requesting it. For example, if you need a power of attorney for Germany, we recommend that an attorney in Germany draft the power of attorney. This helps eliminate potential errors and redo’s.  Also, we recommend that the document be drafted in both languages.  In our example, the power of attorney would be written in English and German.

If your power of attorney is written in a foreign language (Example: German), an English translation may be required. Most States will accept a document written in a foreign language as long as the document has been signed and notarized with proper English notarial wording.

We recommend that you contact us before mailing in your documents in order to avoid any delays or additional cost. Some States will also require County Clerk authentication of the notary’s seal and signature prior to the apostille.

The very first step is to take your power of attorney to a local notary public. The notary must notaries your documents and use proper State notarial wording in English.
